By submitting a request to For What It's Worth ("FWIW," "we," "us," or "our"), you acknowledge and agree to the following Terms of Service.
1. Requests are not guaranteed to be accepted.
Submitting a request does not obligate FWIW to accept or perform the work. FWIW may accept or decline any request at its discretion based on availability, timing, scope, subject matter, fit, or other considerations.
You will not be charged simply for submitting a request.
2. Project scope and agreement.
If FWIW accepts your request, the request, agreed price, deliverables, timing, revisions, upgrades, and any other terms communicated and accepted by you become part of the project agreement.
Requests or changes outside the agreed scope may require additional time, payment, or a separate agreement.
3. Payment authorization.
For projects with a value greater than $0, you may be asked to securely provide a payment method when submitting your request. Payment information is processed by our third-party payment processor and is not stored directly by FWIW.

By providing a payment method and agreeing to these Terms, you authorize FWIW to charge that payment method for amounts due under the accepted project as described above.
4. Creative work is subjective.
FWIW will perform accepted work in good faith using reasonable professional care, judgment, experience, and creative skill.
You acknowledge that creative work is inherently subjective. There is no guarantee that a concept, recommendation, design, piece of writing, strategy, edit, film, name, idea, or other deliverable will match your personal expectations, preferences, or original vision exactly.
FWIW also does not guarantee that the work will achieve any particular personal, commercial, financial, marketing, audience, legal, or other outcome.
By engaging FWIW, you accept the ordinary risks inherent in subjective creative services, including the possibility that you may ultimately dislike, choose not to use, or receive a different result from the work than you expected.
Subjective dissatisfaction alone is not grounds for a refund.
5. Cancellations and refunds.
You may withdraw a request before FWIW accepts it and begins work without charge.
Once work begins, payments compensate FWIW for time, expertise, creative services, and resources already committed to the project. Payments attributable to work already performed are generally nonrefundable except where required by applicable law or otherwise agreed by FWIW in writing.
A refund will not ordinarily be provided solely because you:
This policy applies when FWIW has substantially performed the services and deliverables agreed upon.
If FWIW is unable to substantially perform the agreed services, FWIW may provide an appropriate refund, partial refund, credit, or other remedy based on the work performed, circumstances, and applicable law.
Nothing in these Terms limits any refund or remedy that cannot legally be limited or waived.
6. Revisions and changes.
Any included revision rounds will be established as part of the project scope.
Reasonable feedback and revisions within that scope are welcome. Significant changes in direction, additional deliverables, new concepts, expanded production requirements, or requests beyond the original scope may require additional payment and/or a revised timeline.
7. Timing and customer delays.
Any delivery date provided by FWIW is a good-faith estimate unless expressly agreed otherwise in writing.
Delays in receiving feedback, materials, approvals, access, information, or other required input from you may extend the project timeline.
If a project remains inactive because required customer feedback or materials have not been provided for an extended period, FWIW may close or archive the project after reasonable notice. Restarting an archived project may require a new timeline, scope, or fee.
8. You are responsible for materials you provide.
You represent that you own or have permission to use any text, images, photographs, video, audio, music, trademarks, logos, names, documents, data, or other materials you provide to FWIW.
You authorize FWIW to use those materials as reasonably necessary to perform the requested services.
You remain responsible for claims arising from materials, instructions, or representations you provide.
9. Final review and responsibility for use.
You are responsible for reviewing and approving final work before publishing, distributing, printing, producing, broadcasting, implementing, or otherwise using it.
This includes checking names, facts, claims, spelling, prices, dates, contact information, legal language, technical information, and other material details relevant to your intended use.
To the fullest extent permitted by law, FWIW is not responsible for losses or consequences resulting from your use, modification, publication, production, or implementation of approved work.
10. Legal clearance and third-party rights.
Unless specifically agreed otherwise, FWIW does not provide trademark searches, copyright clearance, rights clearance, regulatory review, legal review, formal fact-checking, or other legal services.
You are responsible for obtaining any licenses, permissions, releases, registrations, searches, or professional legal review required for your intended use.
For naming, branding, taglines, concepts, designs, and similar work, FWIW does not guarantee that a proposed name or creative element is unique, available, registrable, trademarkable, copyrightable, or free from potentially conflicting third-party rights.
11. Ownership of final work.
Unless otherwise agreed in writing, no ownership or usage rights in FWIW-created work transfer until all amounts due for the project have been paid in full.
After full payment, you may use the specifically identified final deliverables created for your project for the purposes contemplated by the project agreement, subject to any third-party rights or licenses.
FWIW retains ownership of its pre-existing materials, processes, methods, tools, templates, systems, know-how, techniques, and other intellectual property that was not created specifically as a final deliverable for your project.
12. Drafts, unused concepts, and working files.
Unless otherwise agreed in writing, preliminary concepts, pitches, drafts, rejected or unused creative directions, explorations, sketches, working materials, source files, and concepts not selected as final deliverables remain the property of FWIW.
Payment for a project does not automatically transfer ownership of every idea, draft, concept, or working file created during the process.
No rights transfer for work associated with an unpaid, cancelled, or declined project.
13. Third-party materials and tools.
Some projects may incorporate or depend upon third-party materials or services, including fonts, stock photography, stock footage, music, software, plugins, open-source materials, platforms, production resources, or other licensed assets.
Those materials remain subject to their respective licenses and terms. Your rights in the final deliverable do not exceed the rights permitted by those third-party licenses.
FWIW may also use contemporary creative and production tools, including software-assisted or AI-assisted tools, when appropriate, while remaining responsible for the creative services FWIW provides.
14. Confidentiality.
FWIW will use reasonable care when handling nonpublic information provided in connection with a project.
However, submitting a request does not by itself create a formal confidential, fiduciary, attorney-client, or similar privileged relationship.
Do not submit highly sensitive, regulated, proprietary, or confidential information unless appropriate arrangements, including an NDA where necessary, have been made in advance.
15. Portfolio and publicity.
FWIW will not publicly share your submitted materials or completed project without permission.
FWIW may ask for permission to feature the project, request, testimonial, or story on its website, portfolio, social media, case studies, or other promotional materials.
Participation is optional. Declining permission will not affect your project.
16. Prohibited requests and right to terminate.
FWIW may refuse, suspend, or terminate a project involving unlawful activity, infringement, fraud, deceptive impersonation, harassment, exploitation, unsafe conduct, abusive behavior, nonpayment, material misrepresentation, or requests FWIW reasonably determines it should not perform.
If a project is terminated after work has begun, payment obligations for work already performed remain subject to these Terms.
17. FWIW does not provide professional advice.
Unless specifically agreed otherwise and provided by an appropriately qualified professional, FWIW's services are creative services and should not be treated as legal, financial, accounting, medical, tax, regulatory, or other licensed professional advice.
You are responsible for obtaining appropriate professional advice when your project requires it.
18. Indemnification.
To the fullest extent permitted by law, you agree to indemnify and hold FWIW harmless from third-party claims, damages, liabilities, and reasonable costs arising from:
This provision does not require you to indemnify FWIW for claims arising solely from FWIW's own conduct where such indemnification would be prohibited by applicable law.
19. Limitation of liability.
To the fullest extent permitted by applicable law, FWIW's total liability arising from an accepted project will not exceed the amount you actually paid FWIW for that project.
To the fullest extent permitted by applicable law, FWIW will not be liable for indirect, incidental, special, exemplary, or consequential damages, including lost profits, lost revenue, lost business opportunities, loss of goodwill, or similar economic losses arising from the services or your use of the work.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
20. Events outside our control.
FWIW is not responsible for reasonable delays or inability to perform caused by circumstances outside its reasonable control, including illness, emergencies, equipment failure, power or internet outages, third-party platform failures, natural disasters, government actions, labor disruptions, or similar events.
FWIW will make reasonable efforts to communicate significant delays and resume work when practical.
21. Files and project retention.
You are responsible for downloading and maintaining backups of final deliverables after delivery.
Unless otherwise agreed, FWIW is not required to retain project files, working files, source files, drafts, footage, or other materials indefinitely and may delete or archive them after a reasonable period following project completion.
22. Governing law.
These Terms and accepted projects are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any legal proceeding relating to these Terms or an accepted project will be brought in an appropriate court located in Minnesota unless applicable law requires otherwise.
23. General terms.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
These Terms, together with your accepted request, agreed scope, price, and any written project-specific terms, constitute the agreement between you and FWIW regarding the project.
Project-specific terms agreed by email or other electronic communication may supplement or modify these Terms for that project.
Failure by FWIW to enforce a provision on one occasion does not waive the right to enforce it later.
24. Eligibility.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into these Terms, to submit a request.
25. Electronic acceptance.
By checking the Terms of Service box and submitting your request, you confirm that you have read, understood, and agreed to these Terms.
You also consent to conducting the transaction electronically and authorize the payment arrangements described above for any request FWIW accepts.
